The following Terms and Conditions constitute an agreement between the Entrants, the Game Operator and the Publisher.

It is important that Entrants read them carefully and understand what they mean. By entering into the Game, Entrants confirm their complete understanding and acceptance of these Terms and Conditions.

Definitions

In these Terms and Conditions:

Game means Match of the Day Fantasy Footy 2016-17. The Game will run on the Website and/or in other partner publications as deemed appropriate by the Publisher from time to time.

Game Judges means the Publisher and Game Operator, and any employees or agents who are specifically designated to make a decision in terms hereof and as it relates to the Game. In this regard the Entrant agrees to abide strictly by such decision.

Game Operator means GFM Clevergames Limited, a company registered in England and Wales number 09150260 and registered address 42 Phoenix Court Hawkins Road, Colchester, Essex, CO2 8JY.

Materials means the text, graphics, photographs, pictures, sounds, digital audio and video clips published on the Websites to publicise the Game.

Players means real life footballers.

Publisher means Immediate Media Company London Limited, a company registered in the United Kingdom under company registration number 06189487, with its registered address at Immediate Media Company Limited, Vineyard House, 44 Brook Green, Hammersmith, London, W6 7BT.

Entrant/Entrants means Entrants of the Websites who make an entry into the Game.

Websites means the following websites:

1. Eligibility

1.1 Minimum Age

Entrants under 12 years of age must receive parental permission at the time of registration. The parent or guardian of Entrants between the ages of 12 and 16 years of age must be notified at the time of registration. Failure to observe this will deem any winning entry invalid and prizes will be forfeited.

1.2 Territory

The Game is intended for play only within the United Kingdom and is governed by English law. Each entrant must ensure that his or her participation in the Game is lawful in accordance with the laws of the country of which he or she is a citizen and/or resides, and/or happens to be at the time his or her entry is made. Neither the Game Operator nor its servants or agents or the Publisher shall be taken to make any representations, express or implied, as to the lawfulness of any entrant's participation.

1.3 Eligibility

Employees of the Publisher, the Game Operator, their respective group companies, agents, and members of their families or households may enter but will NOT be eligible to win or receive prizes.

2. The Game

2.1 Duration

The Match of the Day Fantasy Footy 2016-17 competition will run from August 12th 2016 until the final round of Premier League fixtures on May 21st 2016.

2.2 Entry

Go to www.motdfantasyfooty.com and follow the onscreen instructions. Entrants' entries are free of charge. Entries (and any subsequent changes i.e. transfers) must be made manually by the Entrant via the online form available on the website. Any use of automated processes to take part in this competition is forbidden, and any Entrant suspected of using automated processes may have their teams deleted. This is at the discretion of the Game Operator, and the decision of the Game Operator is final.

Entries can be made at any time during the tournament until May 21st 2016, but to score for the first round of matches on August 12th 2016, entries must be completed by the earliest scheduled kick-off on that day. Entries received up to the earliest kick-off each day will score from that day onwards. Entries received after earliest kick-off each day will begin scoring from the next Gameweek. No Player points will be backdated.

2.3 Teams

The Game is limited to one team per entrant. The Game Operator reserves the right to reject any team/entry name that it considers to be inappropriate or offensive. In such an event, the Game Operator will automatically apply another team name. The Game computer's record of an entry will be regarded as the entry itself. The Game Operator and the Publisher will not be held responsible for entries lost or distorted in transfer. Proof of magnetic transcript is not accepted as proof of entry.

2.4 Eligible Matches

Eligible matches are all games in the Premier League season. Eligible matches will also include a selection of individual fixtures from the La Liga, Bundesliga and Serie A season. These eligible matches are subject to change.

2.5 Notifications

By registering to play the Game you are agreeing to receive in-game e-mail updates. You can unsubscribe from these e-mail updates by following the unsubscribe instructions within the e-mail. The Publisher may from time to time offer Entrants discounts and special promotions at its sole discretion. To qualify for discounts and special promotions online Entrants must comply with the offer conditions.

2.6 Final Decision

If the Game Judges believe at any time that, in their sole opinion, a single Entrant has made more than one registration for a team then we reserve the right to remove all, or some, of those entrants and entries from the Game or make them ineligible for prizes. The Games Judges' decision regarding the exclusion of teams will be final and no correspondence relating to such exclusions will be entered into.

3. Picking Your Team

3.1 Team Selection

Entrants may only select one team for the competition - multiple teams will be deleted.

Entrants may select a maximum of three Players from any one club during the Premier League season. Entrants may select a maximum of three Players from clubs outside the Premier League.

3.2 Player Selection List

Only Players included in the official Game selection list may be included in a team and a Player cannot appear in the same team more than once. Player values are arbitrarily allocated for the purpose of the Game and the Game Operator will not enter into any correspondence regarding Player valuations.

3.3 Formations

Only the positions allocated to Players in the official Game selection list will apply to the Game and the Game Operator will not enter into any correspondence regarding Playing positions allocated for the purpose of the Game. Each team entered into the Game must consist of 11 Players. The 11 playing positions must be selected in one of the following formations:

  • 1 Goalkeeper, 4 Defenders, 4 Midfielders and 2 Strikers (4-4-2)
  • 1 Goalkeeper, 4 Defenders, 3 Midfielders and 3 Strikers (4-3-3)
  • 1 Goalkeeper, 4 Defenders, 5 Midfielders and 1 Striker (4-5-1)
  • 1 Goalkeeper, 3 Defenders, 5 Midfielders, 2 Strikers (3-5-2)
  • 1 Goalkeeper, 3 Defenders, 4 Midfielders, 3 Strikers (3-4-3)
  • 1 Goalkeeper, 5 Defenders, 3 Midfielders, 2 Strikers (5-3-2)
  • 1 Goalkeeper, 5 Defenders, 4 Midfielders, 1 Striker (5-4-1)
  • 1 Goalkeeper, 5 Defenders, 2 Midfielders, 3 Strikers (5-2-3)

Alternatively, Entrants may choose to utilise the 'Auto Select' feature in which case the Game computer will randomly select an eligible team which will be shown on the screen.

3.4 Budget

Entrants must pick an initial team of 11 Players; the total value of the team must not exceed £100m, although there is no obligation to use the full budget.

4. Scoring Points in the Game

4.1 Points

Based on their performance, Players will be allocated points score after each game. Actions occurring in extra time count but penalty shoot-outs do not. Points are awarded as detailed in the table below:

Entrants may use the Power Play booster feature to score double points for a single Game week each month. The Entrant’s entire team’s points will be doubled.

Neither the Game Producer nor the Publisher will enter into any correspondence relating to the allocation of points to Players. We accept no responsibility for the accuracy of this data.

4.2 Assists

A Player will be credited with a 'goal assist' when he delivers/plays the final pass, cross, header or shot, which leads to the goal being scored. This will also apply to set plays (i.e. corner, free kick, throw-in etc.). In addition, an attempt, which rebounds from the goal frame, the goalkeeper or a defender, can be considered as an assist, if it leads directly to a goal. Any direct intervention in play from a defending team does not constitute a rebound e.g. a goalkeeper save or a block/tackle by a defender. When a pass, shot or cross by an attacker contributes to an own goal, an assist can be awarded to the attacker. Only one Player can be credited with an assist per goal scored. No assist is awarded to a Player winning a penalty or a free kick. No assist is given to a Player who creates his own goals coring opportunity (i.e. solo run/dribble).

4.3 Deadlines

The Game week deadlines are detailed on the Rules and FAQs page. These dates are subject to change depending on the fixture schedule.

Any transfers, captain changes or substitutions made after the deadline will become active at the next deadline.

Teams entered after the Game week deadline will not score points for that Gameweek.

4.4 Captains

Entrants must nominate a member of their team to be captain. This Player will score double the number of points they would usually have been awarded that Game week. If the captain does not play then the bonus will be lost. Another Player will not take over the captaincy in their place.

4.5 Transfers

The Publisher and Game Operator will not be responsible for transfers lost in transmission or submitted late whether due to high online traffic or not. In addition to the transfer allocation, Entrants may make unlimited transfers during the pre-season transfer amnesty. This will apply from 00:01 Monday 25 July 2016 until the scheduled kick off of the first eligible match. These dates are liable to change based on fixture rescheduling.

Transfers can be made online only at the official Match of the Day Fantasy Footy website and the mobile site. Entrants may use the transfers page to change their team for the next Game week. Entrant may make 2 transfers per Gameweek in the regular season.

Entrants may use the Bonus Transfer booster feature to gain an additional transfer for a single Gameweek.

If an Entrant does not use their full allocation of transfers for a single Game week, then unused transfers are not carried over to the following Game week. This includes Bonus Transfers.

5. Leagues

5.1 Leagues

Each Entrant competes and is automatically entered in a number of leagues. These are:

  1. The Overall League
  2. Monthly Prize League
  3. A league for supporters of your favourite team
  4. Private leagues with your friends and colleagues. Private leagues are joined at the Entrants discretion and are not compulsory.

Entrants can choose to either create their own Private leagues to compete with friends and colleagues, or join an existing Private league.

In all leagues teams are ranked based on the total points in the game.

6. Boosters

6.1 Booster Overview

The Game features voucher codes which will be published in the official Match of the Day magazine, and redeemed against in-game features by Entrants. The Game Operator will not enter into any discussion around the competitive advantage of Boosters.

6.2 Power Play booster

The Power Play booster is a monthly booster, but may only be applied to an individual Game week within the calendar month. Entering a Power Play voucher code gives the Entrant the ability to score double points for their entire team for a designated Game week only. The Entrant’s captain (who usually receives double points) will have their points quadrupled. There will be a Power Play code published each month. The Entrant can choose to activate this Power Play booster for any given Game week during that month. The Power Play booster must be activated before the transfer deadline for that Game week. The Game Operator will not enter into any discussion around the backdating of Power Play boosters.

6.3 Bonus Transfer booster

The Bonus Transfer booster is a weekly booster. Entering a Bonus Transfer voucher code from the official Match of the Day magazine, gives the Entrant one additional transfer for that Game week. The additional transfer must be used before the Game week transfer deadline. Unused transfers do not carry over from one Game week to another. The Publishers and Game Operator will not be responsible for transfers lost in transmission or submitted late whether due to high online traffic or not.

7. Prizes

7.1 Prizes Page

Entrants shall compete for prizes based on the performance of their Team. Full breakdowns of the prizes on offer are listed on the Prizes page.

7.2 Overall Winners

There will be two Overall prize pools; one for the Over 14s league, and one for the Under 14s league. 2x FA Cup Final tickets will be awarded at the end of the competition to the Entrant whose team is placed at the top of the Overall Over 14s league. 2x FA Cup Final tickets will be awarded at the end of the competition to the Entrant whose team is placed at the top of the Overall Under 14s league. The prize will be awarded to the Entrant whose team has amassed the highest number of points in the Overall league after all the matches within the Game are complete.

7.3 Monthly Winners

There will be two monthly prize pools; one for the Over 14s league, and one for the Under 14s league. The monthly winner will be the Entrant who accumulates the most points over the matches played during each month. The prize will be awarded to the Entrant whose team has amassed the highest number of points after all the matches within the calendar month are complete. The monthly winner from the Over 14s league will be awarded a set value of cinema vouchers. The monthly winner from the Under 14s league will be awarded one of 10 prizes of equal value:

  • Copy of FIFA 17

  • Razor Pro Scooter

  • £50 Pro Direct Voucher

  • KitSound Hive 2 Speaker

  • Arena Headphones

  • Framed Lionel Messi shirt

Please note:

  1. only one prize is awarded per month

  2. prizes shown may have been claimed by a previous month's winner

    1. all prizes are subject to availability

    2. the Publisher will not be liable if a winner does not get their preferred prize if that prize has been claimed by a previous month's winner

  3. monthly prize winners are restricted to one household per season and to one winner per family per season

  4. if there is any reason to believe that a previous month's winner is attempting to claim another prize, the Game Operator reserves the right to exclude them from participating in the competition and/or claiming a prize

7.4 Tiebreak

Teams are ranked based on the total points in the game. In the event of a tie between teams, the team which has registered the most goals during the competition will be positioned higher. If a tie remains, the team which has registered the most assists during the competition will be positioned higher, followed my most clean sheets registered. In the unlikely event that teams remain tied at this stage, the team that was entered in the competition first will be named the winner. 8. General

8.1 Notification of Winnings

Winners will be notified via e-mail and prizes sent out within 28 days of the prize being verified by the Game Judges. If the Game Judges have been unable to contact the winner of any prize within 14 days of that game period or competition ending, the prize will be awarded to another Entrant. In cases where the Entrant in first place has not responded within 14 days, the prize will be awarded to the Entrant of the next highest scoring eligible team in that game period or competition. Winner's names may also appear on the Game Website the day after each prize period is completed. The decision of the Game Judges will be final in all matters relating to the awarding of Game prizes and no correspondence will be entered into and of the league and will not be made payable to any other person under any circumstance.

8.2 Data

By entering this promotion, any Entrant over the age of 18 agrees that the Publisher may use your information to contact you about products and services you may like. You can change your direct marketing preferences by unsubscribing from these e-mail updates by following the unsubscribe instructions within the e-mails. Any Entrants under the age of 18 will not have their data shared with any third party for marketing purposes.

9. Miscellaneous

9.1 No Liability

The Game Operator and the Publisher have made all reasonable endeavours to ensure that the Game is provided using reasonable skill and care. However, no warranties are made whatsoever in relation to the accuracy, suitability, reliability, completeness or otherwise of the Game itself nor in relation to disruptions, delays or errors in connection with the Websites or the internet, in particular for any acts or omissions made by any telecommunications service provider with whom you have contracted to gain access to the Websites, all to which without limitation the Game Operator and the Publisher accepts shall not be held responsible. Further, no warranty is made in respect of information to which you may have access but which has not been directly provided by the Game Operator and/or the Publisher, including without limitation, information on the internet available outside of the Websites which shall remain the responsibility of the provider of such information.

9.2 Limitation of Liability

Except as expressly provided in these Terms and Conditions, and to the extent permitted by law, the Publisher, its employees, agents and partners disclaim any and all liability in respect of any loss or damage arising out of the Game and/or Websites, whether such loss or damage results from negligence, breach of statutory duty or otherwise, and whether in contract or in tort or otherwise, including but not limited to the loss or corruption of data, any errors or omissions, content, delays or interruptions in transmission or operation and lines or communication failure. In no event shall the Game Operator and the Publisher be liable for any loss of profit, goodwill and any indirect, special or other consequential or incidental damage, whether foreseeable or not. In the event that any liability does arise then the liability of the Publisher and/or the Game Operator whether in contract, tort or at law shall be limited in aggregate to the money paid by the relevant Entrant in lieu of registration to play the Game.

9.3 Intellectual Property

Without limitation, all of the Game Materials and content on the Websites is the exclusive property of the Publisher and/or of the companies who may have supplied such Materials to the Publisher. The Material, including compilation, selection, presentation and arrangement thereof, is protected by national laws and international agreements on copyright, moral rights and other intellectual property rights. All promotional and explanatory material on the Websites form part of the Terms and Conditions. Entrants may not modify, reproduce, distribute exchange, sell or transmit any of the Material, nor store it in any form (whether tangible or electronic). Copying or downloading the Material for any business, commercial or public purpose is strictly forbidden. Civil or criminal liability may result from any use in contravention of this clause. The Game's name and logo, and any other graphics, logos and trademarks used on the Websites are protected by laws and international agreements on intellectual property. None of the trademarks may be used in association with the products or services of a third party or in a manner which could, either directly or indirectly, defame or discredit us or a third party. All trademarks and trade names appearing on the Website (including names or products belonging to third parties) remain entirely the intellectual property of the Game Operator or the Publisher or the intellectual property of their respective owners (as the case may be).

9.4 Changes in Terms and Conditions

The Game Operator and the Publisher reserve the right, at both parties sole and absolute discretion, to rule on any unforeseen circumstances or circumstances beyond our control in whatever way the Game Operator and/or the Publisher deem most appropriate (including the cancellation or postponement of the Game or changes to these Terms and Conditions) in order to reach what either party considers to be an equitable solution for the Entrants to the Game. The Game Operator and/or the Publisher's decision will be announced on the Website as soon as reasonably practicable after such decision has been reached. No correspondence will be entered into by the Game Operator or the Publisher in respect of such decision which will be final and binding in all respects.

9.5 Force Majeure

Neither the Game Operator nor The Publisher shall be liable for its failure fully to perform their obligations under this Agreement if and to the extent that such failure is due to reasons of force majeure or change in laws or regulations or any other occurrence beyond either party's reasonable control.

9.6 Prizes

All prizes are underwritten by the Publisher.

9.7 Governing Law

Terms and Conditions relating to the Game and how it's played, managed and prizes awarded shall be governed by and interpreted in accordance with English law and Entrants hereby submit to the exclusive jurisdiction of the English courts in connection with any dispute that may arise regarding any aspect of the Game or the Terms and Conditions.
